For parents of dependent children, a Last Will and Testament should include Trust language for the financial support of your children as well as naming the person or persons you wish to manage the Trust and take care of the children. In the event of death without a Last Will and Testament, the distribution of assets and care of the children is left to the laws of Indiana. Who manages the assets on behalf of the children and who takes care of the children will be left to a judge.
Children with special needs may need care into adulthood. Including a Special Needs Trust in the Last Will and Testament ensures that a disabled child is cared for both financially and personally.
